These Terms and Conditions ("Terms") govern your use of the website located at concretebrookline.com ("Site") and the concrete contracting services ("Services") offered by BKL Brookline Concrete, a contractor based in Brookline, MA. By using the Site or engaging our Services, you agree to these Terms. If you do not agree, do not use the Site or Services.

Information submitted through our online contact form or phone inquiries initiates the estimate process. A written estimate provided to you constitutes a proposal, not a contract. No binding obligation exists between BKL Brookline Concrete and the customer until both parties have signed a written project agreement or contract.
Estimates are based on conditions observable at the time of the site visit. Unforeseen conditions (including but not limited to buried utilities, unexpected soil conditions, hidden structural issues, or permit requirements that become known after work begins) may require a change order and a revised price. We will notify you before proceeding with any work that falls outside the scope of the original written estimate.
BKL Brookline Concrete obtains required permits for projects that need them under applicable Massachusetts and local building codes. Permit fees are either included in the written estimate or itemized separately. It is your responsibility to ensure the proposed work complies with any applicable homeowners association, condominium association, or private deed restriction rules that may apply to your property. We are not responsible for compliance with private restrictions that are not disclosed to us in advance.
Payment terms are set out in each individual written project agreement. Unless otherwise specified in writing, we typically require a deposit at the time of contract signing, a progress payment at a specified milestone, and a final payment upon project completion. Failure to make timely payments may result in a work stoppage until the account is brought current. Late payments are subject to interest as specified in the project agreement.
We warrant our workmanship against defects in materials and labor for a period specified in your individual project agreement, typically one (1) year from the date of substantial completion, unless a longer period is required under Massachusetts law or agreed to in writing.
This warranty does not cover damage resulting from improper use or maintenance, acts of God (including but not limited to severe frost heave, flooding, or extreme weather events), salt or chemical application by the property owner, or modifications made by others after project completion. Concrete is a natural material and minor surface cracking within normal industry tolerances is not a warrantable defect.
To the fullest extent permitted by applicable law, BKL Brookline Concrete's total liability to you for any claim arising out of or relating to the Site or Services shall not exceed the amount paid by you to BKL Brookline Concrete for the specific project giving rise to the claim. In no event shall BKL Brookline Concrete be liable for indirect, incidental, special, consequential, or punitive damages, even if we have been advised of the possibility of such damages. Nothing in these Terms limits our liability for gross negligence, willful misconduct, or matters that cannot be excluded by law.
All content on this Site, including text, photographs, graphics, and logos, is owned by or licensed to BKL Brookline Concrete and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Norfolk County, Massachusetts. You consent to the personal jurisdiction and venue of those courts.
We may update these Terms from time to time by posting a revised version on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. Changes do not affect the terms of any project agreement already signed by both parties.
